Loan modification and debt settlement: Just say no to upfront fees

If you have credit problems, you may be intrigued by those ads promising to “cut your credit card debt in half,”or “slash your debt to pennies on the dollar,” or “free you from the clutches of debt,” yadda yadda yadda. Or, driven to insanity or suicide by your friendly mortgage servicer, you may cave and just turn the whole HAMP mess over to a smiling suit who promises you a mortgage modification with a 2% rate, a principal reduction, and a trip to Disneyland. And that’s fine; these folks are still free to make all the dubious claims they want, and you are free to believe them (it’s easier though after a couple of drinks).

What these companies can no longer do, thanks to Federal Trade Commission (FTC) regulations, is charge you upfront for these services.

One of the biggest complaints against these outfits (besides the inevitable dinner-time calls) was that they made extravagant promises and then once they had extracted a sizable fee from the customer they did nothing. So now they hav

Federal Reserve Bond Purchases Will Help Push Mortgage Rate Drops

The Federal Reserve’s second round of quantitative easing – the spending of more than $600 billion – will impact interest rates on mortgages and other long-term loans, pushing rates down by a fraction of a percentage point, according to a report from The Wall Street Journal. However, the impact on an individual consumer could be minimal.

Most of the consumers across the country who are able to refinance their mortgages have had the opportunity to do so for months, as rates have hovered at or near record lows, the report said. However, many homeowners have opted not to refinance. According to one study, even before the Fed made its first round of bond buying, the national average on mortgage rates was a full point lower than what 56 percent of all consumers were currently paying.

Economists at Goldman Sachs estimate that the bond buying will keep interest rates about 0.15 percent below where they normally would be, the report said. Becau

The Wolf at the Door: What to Do When Collection Agencies Come Calling

Earlier this month we broke the story about Draft Statements of Claim – Collection Agency Dirty Trick Number One. Then, last week, we followed up with Draft Statements of Claim – More on This Questionable Collection Agency Tactic. In both articles we referred to the work of Mark Silverthorn, a former collection agency lawyer who is now working for debtors.

Mr. Silverthorn is the author of The Wolf at the Door: What to Do when Collection Agencies Come Calling, a new book that describes collection agency tricks and tactics, and how you can deal with collection agencies. In our on-going series of Book Reviews, today we review his new book.

I have interviewed Mr. Silverthorn (see the video in the upper right hand corner of this page), and he interviewed me for the chapters on Consumer Proposals and Personal Bankruptcy, so I am familiar with Mr. Silverthorn’s work. In ou

Food Supplier Nash Finch Sued For Sex Discrimination

Linda Young – AHN News Writer

Lumberton, NC, United States (AHN) – The U.S. Labor Department’s Office of Federal Contract Compliance Programs has filed an administrative complaint against a North Carolina company, Nash Finch Co., with systematic job discrimination against 80 women.

Minneapolis, MN-based Nash Finch is the second-largest publicly traded wholesale food distributor in the U.S. It has contracts with the federal government to provide goods and services to more than 200 military bases in the U.S. and overseas.

OFCCP charges that Nash Finch discriminated against 80 qualified women who had applied for positions as order selectors at the Lumberton, NC, plant. Order selectors pull stock from warehouse shelves to fill orders.

In monitoring files, the OFCCP found that the company hired 6 percent of qualified female applicants versus 26 percent of qualified male applicants.

Moreover, this was not the first instance of discrimination that the OFCCP found at a Nash Finch facility, according to the complaint.

Previous investigations at Nash Finch facilities in Norfolk, VA, St. Cloud

Cyber Monday Sees Consumers Across the World Spend More Than $1 Billion

The number of people who participated in Cyber Monday deals increased to about 9 million, up 4 percent from the 8.7 million who were involved last year, the report said. And those consumers spent more money per person – $114.24, up from $102.19 – as well, a jump of 12 percent. In all, the additional spending resulted in sales climbing 16 percent to $1.03 billion, up from $887 million last year.
